Terms of Service
Last updated: October 2026
Overview
Welcome to Everest Music & Piano Centre.
These Terms of Service govern your use of our website, www.everestmusic.com, and purchases made through our online store.
Throughout these Terms, “Everest Music”, “Everest Music & Piano Centre”, “we”, “us” and “our” refer to the business operating this website.
Our online store is powered by Shopify, which provides the ecommerce technology used to display products, process orders and manage online transactions.
By using our website or placing an order, you agree to these Terms of Service, subject to your rights under applicable law.
Please read these Terms alongside our Privacy & Cookie Policy, Returns & Refunds Policy and Shipping Policy.
Nothing in these Terms of Service excludes, restricts or overrides your statutory consumer rights under Irish or applicable EU law.
1. Access and Customer Accounts
You may browse our website without creating a customer account.
When placing an order, you agree to provide accurate, current and complete information, including your contact, billing and delivery details.
If you create an account, you are responsible for maintaining the confidentiality of your login details and notifying us if you become aware of unauthorised access.
You must not use our website for fraudulent, unlawful or malicious purposes.
Where purchases are made by minors, any applicable requirements concerning parental or guardian consent must be observed.
We reserve the right to restrict access to accounts involved in fraudulent activity, misuse or serious breaches of these Terms, subject to applicable law.
2. Our Products
Everest Music & Piano Centre supplies musical instruments, accessories, audio equipment and related products.
We make reasonable efforts to ensure product descriptions, specifications, photographs, pricing and availability are accurate and up to date.
However, product colours and finishes may appear slightly different depending on your screen settings.
Manufacturers may occasionally update product specifications, packaging or accessories.
Where a material product change affects an order, we will inform you and explain the available options before proceeding.
Product availability is subject to stock levels and supplier availability.
Nothing in this section affects your statutory rights where goods are faulty, misdescribed or otherwise do not conform to the contract.
3. Placing an Order
When you place an order through our website, you submit an offer to purchase the selected products at the prices and on the terms displayed at checkout.
An automated order acknowledgement confirms receipt of your order.
We may need to verify payment, stock availability or delivery arrangements before confirming acceptance.
We reserve the right to decline an order for legitimate reasons, including unavailable stock, suspected fraud or a clear pricing error, subject to applicable law.
If we cannot fulfil an order and payment has already been collected, we will arrange a refund without undue delay.
Customers should check their order details carefully before completing checkout.
If you need to amend or cancel an order, please contact us as soon as possible at sales@everestmusic.com.
Our ability to amend an order may depend on whether it has already been processed or dispatched.
Your statutory cancellation rights remain unaffected.
4. Prices, VAT and Payments
All prices displayed on our website for consumer purchases are in euro (€) and include applicable Value Added Tax (VAT), unless expressly stated otherwise.
Any applicable delivery charges or additional costs will be displayed before you complete your purchase.
We reserve the right to change product prices, promotional offers and discounts without prior notice. Changes will not affect orders already accepted, except as permitted by applicable law.
Payments are processed securely through the payment methods available at checkout.
Payment card details are handled by our payment service providers.
We do not require customers to provide payment card information by ordinary email.
Occasionally, an incorrect price may appear due to a technical or administrative error. If we identify a material pricing error before accepting an order, we will contact you to explain the situation and provide the option to proceed at the correct price or cancel.
Any cancellation and refund will be handled in accordance with applicable law.
5. Shipping, Delivery and In-Store Collection
We offer delivery on eligible products to supported destinations, subject to the delivery options and charges displayed at checkout.
Delivery availability and charges may vary depending on the size, weight and destination of an order.
We aim to dispatch orders promptly. Estimated delivery times are provided in good faith but may vary due to stock availability, courier schedules, weather conditions or other circumstances.
Where a delivery deadline applies under consumer law, your statutory rights regarding delayed or non-delivered goods remain unaffected.
Responsibility for Goods in Transit
For consumer orders delivered by a courier arranged by Everest Music, responsibility for loss or damage in transit generally remains with us until the customer, or a person nominated by the customer, takes physical possession of the goods.
Different rules may apply where a customer independently arranges a carrier not offered by us, as permitted by law.
In-Store Collection
Certain larger or heavier instruments, including selected digital pianos, are available for In-Store Collection Only.
Where a product is designated for collection only, this will be indicated during checkout.
Customers complete payment online when placing their order.
Once the order has been processed and the product is ready, Everest Music & Piano Centre will send an email confirming that it is available for collection.
Please do not travel to the store until you have received your collection-ready confirmation email.
Collection Address:

Customers collecting larger instruments should ensure they have suitable transport and assistance where necessary.

6. Intellectual Property
Unless otherwise stated, the website's original content, branding, design, text, graphics and other materials are owned by or licensed to Everest Music & Piano Centre.
Product photographs, manufacturer descriptions, logos and trademarks may belong to their respective owners and are used with appropriate permission or other lawful authority.
You may use our website for personal shopping and other lawful purposes.
You must not reproduce, distribute, commercially exploit or republish protected website content without appropriate permission, except where permitted by law.
All third-party trademarks remain the property of their respective owners.
7. Optional Tools and Third-Party Services
Our website may include features or services provided by third parties, including payment services, finance providers, product reviews or other ecommerce applications.
Some services may be subject to additional terms and conditions provided by the relevant third party.
Where a third-party service is offered, we will aim to make the relevant information available to customers.
Nothing in this section excludes our responsibilities as a retailer under applicable consumer law.
8. Third-Party Websites and Links
Our website may contain links to manufacturers, suppliers, social media platforms and other third-party websites.
These websites are operated independently and may have their own terms, privacy policies and security practices.
We are not responsible for the content or practices of independent third-party websites merely because we provide a link to them.
This does not affect any legal responsibility we may have in connection with products or services sold directly by Everest Music & Piano Centre.
9. Relationship with Shopify
Our online store is powered by Shopify.
Shopify provides the ecommerce platform and supporting technology that enables customers to browse products, place orders and complete purchases.
Purchases made through our online store are transactions between the customer and the business operating Everest Music & Piano Centre, not purchases from Shopify.
Everest Music & Piano Centre remains responsible for its obligations as the seller under applicable consumer law.
Shopify may process personal information in connection with providing its services, as explained in our Privacy & Cookie Policy and Shopify's applicable privacy notices.
10. Privacy and Personal Information
We respect your privacy and are committed to protecting personal information.
Our Privacy & Cookie Policy explains how we collect, process, store and share personal information, including information required to process orders, arrange deliveries and provide customer support.
We process personal information in accordance with applicable data protection legislation, including the General Data Protection Regulation (GDPR).
Where consent is required for non-essential cookies or marketing activities, we will seek that consent in accordance with applicable law.
You can find further information in our Privacy & Cookie Policy, available through our website footer.
11. Customer Reviews and Feedback
Customers may be invited to submit product reviews, feedback, suggestions or comments about their shopping experience.
By submitting feedback for publication, you confirm that the content is your own or that you have the necessary rights to share it.
You grant Everest Music & Piano Centre a non-exclusive, royalty-free permission to display and use the feedback for legitimate business purposes, including product information and promotion, subject to applicable law.
We may moderate or remove content that is unlawful, abusive, misleading, defamatory, fraudulent or otherwise inappropriate.
We do not require customers to leave positive reviews, and any incentivised reviews must be disclosed appropriately.
Personal information associated with reviews will be handled in accordance with our Privacy & Cookie Policy.
12. Errors, Inaccuracies and Omissions
We make reasonable efforts to ensure that information on our website is accurate.
Occasionally, errors may occur in product descriptions, prices, stock availability, promotions or delivery information.
We reserve the right to correct genuine errors and update website information.
Where an error materially affects an order, we will contact the customer and deal with the matter in accordance with applicable contract and consumer law.
We will not unilaterally impose a higher price on an accepted order without the customer's agreement.
13. Prohibited Uses
Customers and visitors must not use our website to:
-
Engage in fraudulent or unlawful activity.
-
Attempt to gain unauthorised access to accounts or website systems.
-
Upload malicious software, viruses or harmful code.
-
Interfere with website security or normal operation.

Harass, threaten or abuse other users or employees.

Collect personal information unlawfully.
-
Use automated systems in a way that disrupts or damages the website.
We may take reasonable action to protect our website, customers and business against misuse, subject to applicable law.
14. Automated Agents and Website Access
Automated software, bots and AI-based agents must not access or interact with our website in ways that compromise security, interfere with normal operation, bypass access restrictions or engage in unlawful data collection.
We may use reasonable technical measures to manage automated access and protect website performance.
Automated tools must comply with applicable laws and any lawful technical restrictions published on our website.
Nothing in this section restricts rights that cannot lawfully be excluded.
15. Suspension and Termination
We may suspend or restrict access to our website or customer accounts where reasonably necessary to prevent fraud, protect security, comply with legal obligations or address serious misuse.
Where appropriate, we will explain the reason for any restriction.
Suspension or termination of website access does not remove rights or obligations relating to purchases already made, including statutory rights to delivery, cancellation, refunds or remedies for faulty goods.
16. Product Warranties and Consumer Rights
We aim to supply products that are of satisfactory quality, fit for their intended purpose and consistent with their description and applicable contractual requirements.
Customers purchasing goods from us have statutory rights under Irish consumer law, including the Consumer Rights Act 2022.
Where goods are faulty, misdescribed or otherwise do not conform to the contract, customers may be entitled to remedies such as repair, replacement, a price reduction or a refund, depending on the circumstances.
Many products are also supplied with additional manufacturer warranties or guarantees.
These commercial warranties are provided in addition to, and do not replace or restrict, statutory consumer rights.
Our Returns & Refunds Policy provides further information about reporting faults and requesting remedies.
17. Limitation of Liability
We do not exclude or limit liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts:
-
Statutory consumer rights.
-
Liability for death or personal injury caused by negligence.
-
Liability for fraud or fraudulent misrepresentation.
-
Any other liability that cannot legally be excluded or restricted.
We are not responsible for losses caused solely by circumstances outside our reasonable control where applicable law permits this limitation.
We do not guarantee that our website will be available continuously or entirely free from temporary technical interruptions.
Any limitation of liability in these Terms applies only to the extent permitted by applicable law and does not remove remedies to which consumers are legally entitled.
18. Customer Responsibility and Indemnification
Customers are responsible for using our website lawfully and for providing accurate information when placing orders.
You must not intentionally damage our systems, misuse our services or infringe the rights of other parties.
Where unlawful conduct causes loss or damage, responsibility will be determined in accordance with applicable law.
Nothing in this section requires consumers to compensate Everest Music & Piano Centre for losses for which they are not legally responsible or removes protections against unfair contract terms.
19. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will not apply to the extent of the invalidity.
The remaining provisions will continue to apply where legally possible.
Nothing in these Terms limits mandatory rights available under consumer protection legislation.
20. Entire Agreement
These Terms of Service, together with the applicable policies and information provided during the purchasing process, form part of the contractual arrangements governing purchases from our website.
Our related policies include:
-
Returns & Refunds Policy.
-
Privacy & Cookie Policy.
-
Shipping Policy.
-
Any specific promotional terms clearly communicated to customers.
Where a provision conflicts with mandatory consumer protection law, the applicable law will prevail.
Nothing in these Terms excludes information or representations that form part of the contract under applicable law.
21. Assignment
We may transfer our rights or obligations under these Terms as part of a legitimate business restructuring, sale or transfer, provided this does not reduce customers' statutory rights or contractual protections.
Customers may not transfer obligations under an existing purchase contract without our agreement where such agreement is reasonably required.
Nothing in this section restricts rights that cannot lawfully be excluded.
22. Governing Law
These Terms of Service are governed by the laws of Ireland.
Nothing in these Terms limits mandatory consumer protection rights that may apply under the laws of a customer's country of residence.
Where applicable law permits consumers to bring proceedings in another jurisdiction, those rights remain unaffected.
23. Language and Translations
Our website and these Terms of Service are primarily provided in English.
Where translations are made available, we aim to ensure they accurately reflect the English version.
Any differences between language versions will be resolved in accordance with applicable law and the rights of the customer.
24. Headings
The headings used in these Terms are included for convenience and ease of reading.
They do not alter the meaning or legal interpretation of the provisions.

These communications may include:
-
Order confirmations.
-
Payment confirmations.
-
Delivery and dispatch notifications.

Essential communications relating to existing purchases may still be sent where necessary.
26. Changes to These Terms
We may update these Terms of Service from time to time to reflect changes in our business, website, legal requirements or services.
The most recent version will be available on our website.
Where changes materially affect customers' existing contractual rights, we will comply with applicable legal requirements.
Changes to these Terms will not retrospectively remove statutory rights or unfairly alter contracts already concluded.
